The website at seichi.moe (the "Site") is owned and operated by seichi.moe ("seichi.moe", "we", "us" or "our"). These Terms of Use ("Terms") govern your use of the Site. Some features may have additional rules posted on the Site, which are part of these Terms.
By using the Site or creating an account, you agree to these Terms. You must be at least 16 years old to create an account. If you don't agree to these Terms, please don't use the Site.
1.1 Creating an account. Some features require an account. When you create one, you agree to give accurate information and keep it up to date. For now, you can delete your account by emailing [email protected] from the address on your account. We may suspend or close your account as described in Section 8.
1.2 Account security. You are responsible for keeping your login details confidential and for everything that happens under your account. If you think someone has used your account without permission, tell us right away. We are not liable for losses caused by your failure to keep your login details secure.
2.1 License. Subject to these Terms, we give you a limited, non-exclusive, non-transferable and revocable license to use the Site for your own personal, non-commercial purposes.
2.2 Restrictions. You may not: (a) sell, rent, license, distribute or otherwise commercially exploit the Site or its content; (b) copy, scrape or collect content from the Site with automated tools, or access the Site in an automated way that puts an unreasonable load on it; (c) try to get around our security, rate limits or moderation; (d) use the Site to build a similar or competing service; or (e) use the Site in a way that breaks the law or harms other people.
2.3 Changes to the Site. We may change, suspend or discontinue the Site, or any part of it, at any time, with or without notice. We are not liable to you or anyone else for doing so.
2.4 No support obligation. We have no obligation to provide support or maintenance for the Site.
2.5 Ownership. Except for content submitted by users (Section 3) and third-party material such as anime screenshots, the Site and its content belong to seichi.moe. These Terms don't give you any ownership rights. All rights not expressly granted are reserved.
2.6 Feedback. If you send us feedback or suggestions about the Site, we may use them freely, for any purpose, without paying you or crediting you.
3.1 Your content. You keep any rights you have in the scenes, photos, comments and other content you submit to the Site ("Your Content"). By submitting it, you give seichi.moe a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, display and distribute Your Content on the Site and in connection with running and promoting it. This license lasts for as long as Your Content is on the Site. Because scenes are shared reference information, scenes you add may stay on the Site after you delete your account, without your name attached.
3.2 Your responsibility. You confirm that you have the right to submit Your Content and that it doesn't break these Terms or the law.
3.3 Content rules. When you submit content, you agree that:
3.4 Moderation. We review new scenes before they are published and may review any content. We may refuse, edit or remove any content, at any time and for any reason, including if we believe it breaks these Terms. We are not obligated to monitor content and are not responsible for content submitted by users.
3.5 Anime screenshots. Anime, screenshots and the characters in them belong to their respective rights holders. They are shown on the Site to identify the scenes that real places appear in. seichi.moe is not affiliated with or endorsed by those rights holders.
3.6 Copyright complaints. If you believe content on the Site infringes your copyright, email [email protected] with: the work you believe is infringed; the URL of the content; your contact information; a statement that you believe in good faith that the use isn't authorized by the owner, its agent or the law; and a statement that the information in your notice is accurate and that you are the owner or authorized to act for the owner. We will remove infringing content and may close the accounts of repeat infringers.
Many locations on the Site are private property, homes, schools, shrines, temples or places where people live and work. If you visit them:
Locations, directions, recommended times and other details on the Site are submitted by users and may be wrong or out of date. Places change, and access can be restricted at any time. You visit any location at your own risk, and we are not responsible for your travel or for what happens during your visit.
Our Privacy Policy explains what personal information we collect, how we use and share it, and how we use cookies (see its Cookies section). By using the Site, you acknowledge that we will handle your information as it describes.
6.1 Third-party services. The Site links to and works with services run by others, such as AniList, MyAnimeList, Google, Discord, Mapbox and map apps for directions ("Third-Party Services"). We don't control or endorse them and are not responsible for them. Your use of a Third-Party Service is governed by its own terms and privacy policy.
6.2 Other users. Your interactions with other users are between you and them. We are not responsible for any loss or harm from those interactions, and we may, but don't have to, get involved in disputes between users.
6.3 Release. To the fullest extent permitted by law, you release seichi.moe from all claims, demands and damages of any kind arising out of or related to other users or Third-Party Services.
7.1 Disclaimers. THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, SEICHI.MOE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ITS CONTENT, INCLUDING LOCATIONS AND DIRECTIONS, IS ACCURATE.
7.2 Limitation of liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) SEICHI.MOE WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE; AND (B) OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SITE IS LIMITED TO US $50. Some jurisdictions don't allow some of these limits, so they may not all apply to you.
7.3 Indemnification. You agree to defend, indemnify and hold harmless seichi.moe from any claims, and reasonable costs and attorneys' fees, arising out of (a) Your Content, (b) your use of the Site, including your visits to locations, (c) your violation of these Terms, or (d) your violation of any law or the rights of others. We will let you know about any such claim and may take control of its defense.
These Terms apply for as long as you use the Site. We may suspend or end your access to the Site, or suspend or delete your account, at any time and for any reason, including if we believe you have broken these Terms. We are not liable to you for doing so. Sections 2.2 to 2.6, 3 and 5 to 9 continue to apply after your access ends.
9.1 Changes to these Terms. We may update these Terms. If we make significant changes, we will let you know on the Site or by email, and the date at the top of this page will change. If you keep using the Site after the changes take effect, you accept the updated Terms.
9.2 Governing law and courts. These Terms, and any dispute arising out of or related to them or the Site, are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law rules. You and seichi.moe agree to the exclusive jurisdiction of the state and federal courts located in Oregon. Either party may still bring an individual claim in small claims court where it qualifies. If you live outside the United States, this doesn't take away any protection you have under the mandatory consumer laws of the country where you live.
9.3 Electronic communications. You agree to receive communications from us electronically, by email or by notices on the Site. These communications satisfy any legal requirement that they be in writing.
9.4 Accessibility. We want the Site to be usable by everyone, including people with disabilities. If you have trouble using any part of the Site, or have suggestions, email [email protected].
9.5 Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and seichi.moe about the Site. If any part of these Terms is found unenforceable, it will be changed only as much as needed to make it enforceable, and the rest stays in effect. If we don't enforce a part of these Terms, that doesn't waive our right to do so later. "Including" means "including without limitation". You may not transfer these Terms to anyone else without our written permission; we may transfer them. If a translation of these Terms differs from this English version, the English version controls.
